The purpose of this document is to define, on the one hand, the general conditions of use of the site www.louisvanlint.org, hereinafter referred to as "the site" or "our site", made available by the Louis Van Lint Institute, hereinafter referred to as "the author", and, on the other hand, the manner in which the user accesses the site and uses its services.
Please read the Terms of Use carefully before you start to use the site. By using the site, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the site.
The site is offered and available to users who are 18 years of age or older. By using our site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use our site.
1. Access to the site
a) The author endeavours to allow access to the site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the author's control, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the site and services.
Consequently, the author cannot guarantee the availability of the site and/or services, the reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided to the user either by electronic or telephone means.
The author cannot be held responsible in case of impossibility of access to this site and/or use of the services.
Furthermore, the author may be required to interrupt the site or part of the services at any time without notice, without any right to compensation. The user acknowledges and accepts that the author is not responsible for any interruptions, and the consequences that may result for the user or any third party.
b) The user of this site acknowledges having the competence and means necessary to access and use this site. The author shall not be held responsible for elements outside his control and for any damage that may be suffered by the user's technical environment and in particular, his computers, software, network equipment and any other material used to access or use the service and/or information.
c) After registration, the user undertakes not to transmit his password or access permission to third parties. In the event of non-compliance with the conditions contained herein, access will be denied to the user.
d) It is reminded that unauthorised access or maintenance in a computer system, causing any damage, even if not intentional, to the computer system or to the data in this system, introducing or modifying or deleting data in a computer system without authorisation, or modifying by any technological means the normal use of data in a computer system, constitute offences punishable by criminal sanctions. This list is illustrative and non-exhaustive of offences against the confidentiality, integrity and availability of computer systems and the data stored, processed or transmitted by such systems.
2. Intellectual property - Copyright
a) The entire content of the site as well as the texts, graphics, images, sounds and videos including domain names, trademarks, models, emblems, logos, computer programs / software, databases, and all other information on the site, is the exclusive property of the author; it is protected by the laws in force under Belgian legislation on intellectual property.
b) For the publication of the site, the author has obtained the permission of Mrs. Van Lint, daughter of the artist and entitled to the patrimonial rights (including reproduction rights) and moral rights, as well as from the authors of the computer programs (software), databases, etc. that made it possible to build the site.
c) No element of this site may be copied, reproduced, distorted, mutilated or otherwise modified, in any way, in any form, on any medium and by any means whatsoever, without constituting an act of infringement within the meaning of Articles XI.293, XI.303-304 and XI.318 of the Belgian Economic Law Code (Wetboek van economisch recht - Code de droit économique).
d) Any communication, publication, representation, reproduction, distribution, disclosure and/or any form of exploitation by sale, assignment, rental, loan, making available or transfer whatsoever, partial or total of the contents and services offered by the site, by any process whatsoever, may not be made without the prior written permission of the author.
3. USE OF THE SITE FOR NON-COMMERCIAL PURPOSES
a) The site and its contents may only be consulted by duly registered persons, and are made available exclusively for personal, non-commercial and educational use. Commercial use of the site and its contents is strictly prohibited. For example: it is forbidden to make the site and its contents available to persons or third parties for commercial or political purposes. Commercial publication, exploitation or distribution in any way whatsoever of the site and/or its contents without the written permission of the author is strictly prohibited.
b) Without prejudice to what is stipulated in paragraph 3 a), the user agrees to use the site only for lawful purposes and in accordance with the general conditions of use of the site.
c) The user agrees not to use the site in any way that violates national and international laws.
d) The user undertakes not to damage the site and/or its contents, in particular by introducing viruses, Trojan horses and/or malicious software.
e) The user undertakes not to harm, in any way whatsoever, the proper functioning of the site.
4. Responsibility of the author
a) The information and/or documents appearing on this site and/or accessible through this site come from sources considered to be reliable. This information and/or documents are sometimes liable to contain errors. The author will make the necessary corrections as soon as these errors have been brought to his attention.
In any case, the author cannot be held responsible for any error of any nature whatsoever. The information and/or documents available on this site may be modified at any time, and may have been updated. In particular, they may have been updated between the time they are downloaded and the time the user becomes aware of them.
b) The use of the information and/or documents available on this site is made under the full and sole responsibility of the user, who assumes all the consequences that may result from it, without the author being held responsible in this respect, and without recourse against the latter.
The author cannot be held responsible for any damage of any nature whatsoever resulting from the interpretation or use of the information and/or documents available on this site.
c) The author endeavours to provide regularly updated information, particularly on current events as well as on the content of the articles. However, erroneous information or omissions may be found, particularly as a result of typing or layout errors. If you notice such errors or omissions, the author invites you to report them so that they can be corrected.
The author also reserves the right to modify or not to modify the information provided by this site, within the framework of ongoing research.
d) The user declares to accept the characteristics and limitations of the Internet, and in particular acknowledges that :
- The author assumes no responsibility for the services accessible via the Internet and exercises no control whatsoever over the nature and characteristics of the data that may transit through its server centre.
- The user acknowledges that data circulating on the Internet may be regulated in terms of use or be protected by a property right or copyright distinct from the author's intellectual rights, and undertakes to respect them.
- The user is solely responsible for the use of the data he consults, queries and transfers on the Internet.
- The user acknowledges that the author has no means of control over the content of the services accessible on the Internet.
e) The site may contain hyperlinks to other sites on the Internet.
The hypertext links implemented within the site, in the direction of other sites and/or personal pages and in a general way towards all existing resources on the Internet, do not engage the responsibility of the author. Likewise, the author cannot be held responsible in any way for sites with a hypertext link to the present site and declines all responsibility for their content and use.
f) It is possible to create a link to the presentation page of this site without the express authorisation of the author. No authorization or request for prior information can be required by the author with regard to a site that wishes to establish a link to the www.polbury.org site. However, the site www.polbury.org should be displayed in a new browser window. However, the author reserves the right to request the deletion of a link that he considers not in conformity with the purpose of the site or that he considers prejudicial to his interests.
5. Disclaimer of Warranties
You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the site will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site or any services or items obtained through the site or to your downloading of any material posted on it, or on any site linked to it. 8. Modification of the general conditions of use
The author reserves the right to modify, at any time and without prior notice, these general conditions of use in order to adapt them to the evolutions of the site and/or its exploitation and to the legislation in force. Your continued use of the Site following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page so you are aware of any changes, as they are binding on you.
9. Jurisdiction
The general conditions of use and their interpretation are subject to Belgian law. In case of dispute, only the court of Brussels is competent.
